Jan D. Gibson is a former litigator with twelve years of technical and administrative insurance claims experience, including helping to develop and implement an in-house computerized claims system that processed thousands of mass toxic tort claims for a national property casualty insurance company.
Jan’s primary areas of practice include e-document discovery, attorney-client privilege, and insurance coverage. As manager of the Baudino e-Center, she oversees all electronic document review projects. She also advises healthcare clients regarding the 2009 E-prescribing incentives and electronic health records demonstration project promoted by the Centers for Medicare and Medicaid Services.
Through her insurance coverage practice, Jan investigates and advises clients on insurance issues such as Directors & Officers Liability Insurance Coverage for legal expense indemnification. She is also available to counsel on matters such as risk evaluation, bad faith claims handling and claim reporting to meet insurance policy requirements.
RECENT REPRESENTATIVE MATTERS
- Served on the due diligence team for a multi-million dollar Hospital lease acquisition on behalf of a nonprofit health system client. Also analyzed all lines of insurance coverage, including self insurance, carried by the seller and its hospital authority, and worked directly with senior insurance company officers to obtain commercial property insurance commitments to pay over $30 million toward the construction of a permanent replacement hospital.
- Supervised the development of the virtual due diligence room for client access and review of thousands of documents and the creation of the interactive online due diligence index for 24/7 client access.
- Managed the Baudino e-Center, which consisted of 24 reviewers of the electronic review of 9 million privileged and non-privileged images for two litigation cases for one hospital client, resulting in 3 million images of production.
CAREER EXPERIENCE
- Litigation, including jury trial experience, in civil and criminal matters.
- Volunteer Mediator in court ordered and voluntary civil mediations for over ten years.
- Supervised coverage positions and claims handling for an insurance company on toxic tort claims: asbestos, mold, silica.
- Helped to develop and train an insurance company’s claims department to use several in-house claim computer systems for proper administration of tens of thousands of claims.
- Researched, recommended, and defended insurance coverage positions nationwide for an insurance company.
- Researched, drafted, and published insurance company newsletter designed to share legal trends, report claims data, and advised of changes in insurance policy language.
- Organized a team of underwriters, actuaries, accountants, and technology experts to develop, streamline, and electronically share claim reporting requirements for all toxic tort and environmental claims.
- Served on insurance company’s Mold & Asbestos Task Forces.
- Investigated, managed, and resolved bodily injury claims for Cook County, Illinois.
- Investigated, managed, and resolved all environmental claims in a ten state Midwest region.
